The court heard testimony during hearings on January 23, February 2 and March 2 from witnesses concerning the alleged victim’s medical history.
Chief District Court Judge W. Terry Ruckriegle said that none of the witnesses convinced him that the accuser intended to waive her confidentiality rights by discussing her medical conditions and treatment with others.
The 25-year-old Bryant is accused of sexually assaulting the woman on June 30 at a Colorado resort, a Class 3 felony with penalties ranging from four years to life in prison or 20 years to life on probation.
Bryant, who was in Colorado for surgery on his right knee at the time of the alleged assault, claimed the two had consensual sex.
Bryant’s attorneys wanted access to the medical records of the woman accusing the Lakers star of rape because they believe it would show that she had mental problems that may have affected her perception of what happened at the resort.
