Kobe’s attorneys cleared to question accuser

03.11.2004

Eagle, CO (Basketball News) - The Colorado Supreme Court denied the prosecution’s appeal to keep Kobe Bryant’s accuser from answering questions about her sexual history.

The 19-year-old female will eventually have to provide some details about her past, with the proceedings expected to take place behind closed doors on March 24-25.

Bryant’s attorneys have argued that the sex life of the woman accusing the Lakers’ star of sexual assault should be admissible during the trial.

The defense insisted that the accuser had sex with someone else less than 15 hours after her alleged assault by Bryant, and that she had "multiple acts of sex" in the three days prior to her encounter with him.

The woman’s attorney attempted to protect the witness on the strength of Colorado’s "rape shield" law, which prohibits using an alleged rape victim’s sexual history to discredit one’s case.

The prosecution has publicly proclaimed the idea of their client having sex with someone so soon after the incident as "patently false."

The Colorado Supreme Court does not often get involved in such appeals, but felt the need to do so in this high-profile case.

The 25-year-old Bryant is accused of sexually assaulting a 19-year-old woman on June 30 at a Colorado resort, a Class 3 felony with penalties ranging from four years to life in prison or 20 years to life on probation.

Bryant, who was in Colorado for surgery on his right knee at the time of the alleged assault, claimed the two had consensual sex.
