Report: Prosecutors to dismiss case against Kobe

ABC News is reporting that prosecutors are asking the judge to dismiss the case with prejudice, meaning that charges cannot be refiled at a later date. The report also says that the alleged victim was unwilling to move forward with the charges. The motion could be made as early as late Wednesday afternoon local time.

The trial against Bryant was on track to begin on Friday. The past week has seen both sides interview possible jury members in preparation for the start of the trial.

The 26-year-old Bryant is accused of sexually assaulting a then 19-year-old woman more than a year ago while in Colorado for surgery on his right knee. The charges brought along with it include a Class 3 felony with penalties ranging from four years to life in prison or 20 years to life on probation.

Bryant admits to having consensual sexual relations with the woman, but says he is only guilty of adultery. Bryant is married and has one child.

The alleged victim filed a civil suit against Bryant on August 10.
